The Collapse of the 28-Clause Peace Initiative for Ukraine: How Peace Negotiations Continue to Falter

Europe breathed a deep collective sigh of relief on Monday, as the diplomatic emergency triggered by the introduction of a new 28-point plan for ending the war appeared – briefly – to have been defused. A American diplomat spoke of "significant advancement" after bilateral negotiations in Geneva. On Monday night, Moscow made its retaliation: an extensive attack of missile and drone strikes on Kyiv.

The Pattern of Negotiation and Warfare

The sequence of conflicting incidents captured the bleak nature of the outgoing year. By day, diplomatic battles are waged: hopeful statements are delivered from multiple capitals. Immense energy is devoted on containing specific proposals. By night, the Kremlin brutally reminds the world that, for them, military action persists as the key method for achieving "peace".

Nocturnal Warfare

As military strikes unfolded into the early hours of Tuesday, the current condition of Ukraine's defenselessness was laid bare. Ukraine is able to track projectile deployments from across the border, a capability provided through timely intelligence. From observation points, defense planes that had been scrambled to counter approaching aerial threats streaked across the sky – advanced fighter aircraft delivered to Ukraine by European allies.

Moments later, Kyiv's missile defense engaged: several firings deployed against a hostile projectile. This was a sophisticated defense system at work, most likely delivered by allied countries. Every deployment shakes the surroundings, shaking the windows. The instant of fear quickly transforms into sober acceptance: perhaps the approaching threat won't strike its target this time, preventing destruction from devastation and another blackout.

Ongoing Risks

Following this, a heavy machine gun fired at a drone somewhere nearby, part of a defensive team – most likely allied-provided weaponry. Regrettably, the projectiles didn't strike the opposing UAV – it pressed on overhead toward its target.

Periodically, this carried on until dawn. Kyiv faced the morning news: several casualties, devastation and heating outages in many homes as a result of the evening attack. As customarily, everyone still maintained normal activities – experiencing conflict. But those full day illustrated Ukraine's vital need on international aid – a dependence that European nations are demonstrably unable to replace in the immediate future.

Ineffective Peace Efforts

The comprehensive proposal from Washington sparked intense emotion, discussion and deep concern – and briefly redirected concern from Ukraine's major integrity crisis in years. Yet, we have experienced comparable situations, after prior negotiation attempts and international summits.

Every new approach from US leadership unfolds according to the consistent cycle: a negotiation push against Ukraine, which Kyiv, with other European capitals, manages to fend off. They stabilise the situation but never actually secure success. This cycle will, certainly, continue.

Strategic Calculations

It is easy to blame specific actors of repeatedly advocating Kremlin's demands. But that does not seem to be the complete picture. US administration works based on a assumption familiar among seasoned negotiators: you cannot secure via talks what you have failed to defend militarily. The US administration presumes that it is unfeasible to pressure the Kremlin to relinquish the territory that it currently occupies in Ukraine's south or east.

The issue is that while accepting these circumstances, American administration does minimal to prevent Kremlin actions, through words or deeds, from thinking that the current condition will not change more in its favour in the coming year.

Opposing Positions

Therefore, Russian leadership is convinced that time is on his side – that Ukraine and its partners are approaching exhaustion. Their reason to accept conditions that does not give them the maximum possible gain is almost completely absent. There may be numerous efforts to achieve ceasefire, but they will persist as long as Russia's leadership remains highly assured in the outcome.

On the contrary, Ukraine's government believes that Ukraine can still endure, gradually sacrificing civilians and areas but averting a complete military breakdown until conditions improve in its advantage.

Present Conditions

Factually, there are no actual prerequisites for a ceasefire. Now, individual motivations are entering the equation: personal goals to mediate resolution and obtain worldwide acknowledgment, and Kyiv's double obstacles – on one hand, not to estrange crucial supporters, and on the other, to mobilize citizens around the country's interests against any initiative Kyiv finds unworkable, so that their attention does not move to internal issues. And although their objective will now be significantly challenging after current events, it remains very improbable that this will alter their fundamental strategy.

These two forces are guiding negotiations.

Conclusion and Outlook

It took a only one week to kill the suggested clauses of the most recent proposal. Assertive and inconsistent approach of the matter by US administration, opposition by Ukraine and the other European countries, along with calming attempts of representatives, and finally, current information leaks, all achieved their purpose.

While new initiatives based on previous concepts are approaching, Kyiv, London and other allied nations should draw one fundamental conclusion: Ukraine and Europe will only be able to counter diplomatic offensives from Washington that are founded on Moscow's terms and reflect specific hesitation to alter the situation, if they stand together and strengthen their defence capabilities at a considerably quicker tempo. If they do, no combination of diplomatic or military actions will be able to break them. In the meantime, Ukraine's ability to repel nightly air assaults will, for the foreseeable future, primarily depend on continued Western support.
